1. Parties and Scope

These Terms of Use govern access to and use of the LAND3 Simulations developer portal (the "Portal") between LAND3 Simulations, as named in the Impressum ("LAND3", "we"), and the person using the Portal ("you"). If you use the Portal on behalf of a company or other organization, you confirm that you are authorized to accept these Terms on its behalf, and "you" includes that organization.

The commercial terms for the L3DRM service (fees, service scope, billing) are agreed through contrail.shop and are not changed by these Terms. These Terms add the rules for using the Portal and, in particular, your duties when handling end-user data.

2. Accounts

• Portal accounts are personal. Do not share login credentials; invite team members with their own accounts instead.
• Keep your credentials secure and tell us without undue delay if you suspect that an account has been compromised.
• The account holder of a project is responsible for the team members they invite and for removing access that is no longer needed.

3. End-User Data

The Portal shows you personal data of the end users of your add-ons, such as simulator user names, activation keys, activation and session data, and integrity or tamper events. LAND3 is the controller of this data (see the Privacy Policy). We make it available to you only so that you can support your customers. You agree to:

• use end-user data only for license support, activation key management and the prevention of abuse of your own add-ons;
• not use it for any other purpose, in particular not for marketing, profiling or tracking, and not combine it with other data sources;
• not disclose it to anyone except your own staff and service providers who need it for these purposes and who are bound to the same obligations and to confidentiality;
• keep it confidential and protect it with appropriate technical and organizational measures;
• delete exports and copies as soon as they are no longer needed for these purposes;
• inform LAND3 without undue delay, and in any case within 24 hours of becoming aware of it, of any suspected unauthorized access to or disclosure of end-user data from the Portal.

4. Data Subject Requests

If an end user asks you for access to, correction or deletion of their data processed through L3DRM, or objects to its processing, forward the request to LAND3 without undue delay via the contact address in the Impressum. Do not change or delete end-user data in response to such a request unless we ask you to.

5. API Keys and Access Tokens

Client API keys, project API keys and developer access tokens are confidential. Do not publish them outside the builds they are intended for, and revoke or rotate them without delay if you suspect misuse.

6. Prohibited Use

You must not attack, probe or overload the Portal or the L3DRM service, circumvent access controls or rate limits, access data of other developers, scrape the Portal by automated means other than the documented interfaces, or use the Portal in violation of applicable law.

7. Suspension and Termination

We may suspend or terminate access to the Portal, in whole or for individual accounts, if you breach these Terms, in particular Section 3, or if this is necessary to protect end users, other developers or the service. Where reasonable, we will notify you in advance. Your obligations under Section 3 continue after access ends for as long as you still hold end-user data.

8. Liability

LAND3 is liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability is mandatory under applicable law (including the German Product Liability Act). Otherwise, liability for the Portal is excluded to the extent permitted by law. Any liability provisions in the commercial terms agreed through contrail.shop remain unaffected.

9. Changes, Governing Law

We may amend these Terms. The amended version applies once you accept it; the Portal asks you to do so at your next login. If you do not accept, you can no longer use the Portal.

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the place of jurisdiction is Mannheim, Germany.
